Acceptance of terms

By accessing or using Marketing Podcast Network websites, pages, tools, member areas, ecommerce checkout flows, or related services, you agree to these Terms and any policies referenced here, including the Privacy Policy and DMCA Policy. Marketing Podcast Network, LLC may update these Terms from time to time. Continued use of the site after updated Terms are posted means you accept the updated Terms.

What MPN provides

Marketing Podcast Network is a network, directory, discovery, publishing, promotion, advertising, and creator-support platform for marketing and business podcasts. The site may include show pages, episode pages, podcast artwork, descriptions, embedded audio, transcripts, show notes, articles, AI-powered workflow tools, sponsorship information, ecommerce checkout, and third-party links.

The site is not a law firm, financial adviser, tax adviser, talent agency, or rights-clearance service. Content, tools, and recommendations are provided for general business and informational use.

Creator and member content

Podcast creators and member shows retain ownership of their shows, episodes, recordings, artwork, titles, names, logos, trademarks, host names, guest content, descriptions, transcripts, clips, and other materials they own or control.

By submitting, syndicating, importing, authorizing, or otherwise making creator content available to MPN, the submitting party grants MPN a limited, non-exclusive, worldwide, royalty-free license to host, cache, display, embed, index, reproduce, transmit, excerpt, promote, and technically adapt that content only as reasonably necessary to operate, improve, market, archive, and promote the network, the site, the relevant show, and related sponsorship opportunities.

Technical adaptations may include resizing images, formatting text, creating thumbnails, generating transcripts or summaries, normalizing metadata, embedding players, caching pages, creating short promotional excerpts, and similar technical changes for display, accessibility, search, syndication, analytics, or network promotion. This does not transfer ownership to MPN.

Member-specific rights, advertising permissions, revenue-share terms, offboarding obligations, and content-removal procedures should be governed by the signed member agreement or other written agreement between MPN and the creator. If a written agreement conflicts with these public Terms, the written agreement controls for that relationship.

Creator warranties and responsibilities

If you submit, authorize, or syndicate content to MPN, you represent that you have all rights, licenses, consents, releases, and permissions needed for MPN to use that content as described in these Terms and any applicable member agreement. That responsibility includes rights related to music, sound effects, third-party clips, guest interviews, guest likenesses and voices, artwork, logos, trademarks, photographs, transcripts, AI-generated materials, sponsor copy, affiliate disclosures, and any other material included in a show, episode, article, or submission.

MPN intellectual property

The MPN name, logos, marks, site design, page layouts, original editorial content, AI tool interfaces, taxonomies, directory structure, product names, software, workflows, and the selection, coordination, and arrangement of the network library are owned by MPN or its licensors unless otherwise stated. You may not copy, scrape, reproduce, resell, frame, mirror, or commercially exploit the MPN site, directory, database, tools, branding, or compilation except as expressly allowed by MPN in writing.

Member shows may use approved MPN names, logos, badges, and marketing assets only for truthful network participation, cross-promotion, and sponsorship-related purposes, subject to MPN brand guidance and any member agreement.

Third-party podcast and guest content

Episodes may include guests, music, clips, sponsor messages, platform embeds, and other third-party material controlled by the relevant show owner, publisher, guest, sponsor, platform, or licensor. MPN does not independently clear every third-party right in every episode. MPN may remove, disable, restrict, update, or annotate content when it receives a credible rights complaint, platform request, legal demand, member offboarding request, or other notice that creates legal, reputational, operational, or user-safety risk.

User submissions and comments

If you submit comments, testimonials, applications, form responses, messages, reviews, guest information, media, or other non-member content, you grant MPN a non-exclusive, worldwide, royalty-free license to use, store, reproduce, display, edit for formatting or clarity, and process that material as needed to operate the site, evaluate requests, provide services, moderate content, and promote MPN.

You may not submit content that is unlawful, misleading, infringing, defamatory, abusive, obscene, harassing, malicious, spammy, or designed to compromise site security or user trust.

AI-powered tools and outputs

MPN may offer AI-powered tools for podcast planning, show notes, transcripts, clips, summaries, metadata, search visibility, sponsor materials, and other creator workflows. AI outputs may be incomplete, inaccurate, outdated, biased, or unsuitable for a particular purpose. You are responsible for reviewing, editing, fact-checking, rights-checking, and approving any AI-generated or AI-assisted output before publishing, sending, selling, or relying on it.

Do not submit confidential, regulated, sensitive, or third-party proprietary information to AI tools unless you have the right to do so and accept the associated processing risk. AI tools do not provide legal, financial, medical, tax, or professional advice. MPN may meter access through credits, plans, accounts, usage limits, abuse prevention, or ecommerce checkout.

Purchases, credits, memberships, and ecommerce

MPN may sell memberships, services, production packages, AI credit packs, digital tools, sponsorship products, or other offerings through WooCommerce, Stripe, or other payment providers. Checkout, billing, payment processing, fraud screening, taxes, receipts, and stored payment methods may be handled by third-party providers under their own terms and privacy policies.

Unless a product page or written agreement says otherwise, digital products, AI credits, subscriptions, production services, and custom services are provided as described at the time of purchase and may be subject to usage limits, expiration, approval, fulfillment timelines, and platform availability. Refund, cancellation, renewal, credit expiration, unused-credit, and service-scope terms should be stated on the relevant checkout page, order terms, or written agreement. Where those terms are not stated, MPN may evaluate refund or credit requests case by case, but is not obligated to refund consumed digital credits, completed services, custom work, or already-delivered digital outputs except where required by law.

Advertising, sponsorship, and affiliate disclosures

The site may include sponsorship information, affiliate links, partner recommendations, paid placements, media-kit materials, advertising inventory, or network promotion. MPN may receive compensation when users purchase through affiliate links or when brands advertise through the network. Advertisers and sponsors are responsible for the accuracy and legality of claims, copy, landing pages, offers, regulated-industry disclosures, and creative materials they provide.

Prohibited conduct

You may not attempt to breach site security, access non-public areas without authorization, interfere with the site, scrape at scale, reverse engineer private tools, submit malicious code, impersonate another person, misrepresent rights ownership, evade usage limits, abuse AI tools, or use the site for unlawful, deceptive, infringing, or harmful activity.

Third-party links, embeds, and platforms

The site may link to or embed content from podcast hosting platforms, podcast apps, YouTube, Spotify, Apple Podcasts, analytics providers, ecommerce providers, social platforms, affiliate partners, media-kit hosts, or other third parties. MPN does not control those services and is not responsible for their content, availability, policies, tracking, payments, or security.

Copyright complaints and repeat infringers

MPN maintains a DMCA Policy for copyright complaints, counter-notices, and repeat-infringer handling. MPN will reasonably respond to proper notices and may remove or disable access to content when appropriate. MPN may terminate or restrict accounts, member access, or content relationships for repeat infringers or repeat rights violations.

Disclaimers and limitation of liability

The site, directory, content, AI tools, ecommerce flows, analytics, recommendations, and services are provided on an as-is and as-available basis. To the fullest extent allowed by law, MPN will not be liable for indirect, incidental, consequential, special, exemplary, punitive, or lost-profit damages arising from use of the site, podcast content, member content, AI outputs, third-party platforms, ecommerce providers, or services.

Indemnification

You agree to indemnify, defend, and hold harmless MPN, its affiliates, officers, members, employees, contractors, service providers, and representatives from claims, liabilities, losses, damages, costs, and expenses, including reasonable attorneys’ fees, arising from your content, your rights clearances, your use of the site, your misuse of AI tools, your purchases, your violation of these Terms, or your infringement or violation of any third-party rights.

Governing law

These Terms are governed by the laws of the United States and the Commonwealth of Kentucky, without regard to conflict-of-law rules.
